We reserve the right to decline any service request at our discretion, including requests that present unsafe conditions for our crew, requests outside our service area, or requests for equipment or vehicle types we are not equipped to handle.
Any estimate provided before the commencement of services is based on the information available at the time of dispatch. The final price may differ from the initial estimate if the actual job conditions differ materially from the information provided - for example, if a vehicle is in a more difficult position than described, if additional equipment is required, or if the distance traveled differs from what was stated.
We will communicate any significant change in scope before proceeding with additional work, where circumstances permit. Certain tow types in California are subject to rate regulation by local authorities. If a police-ordered or non-consensual tow is involved, applicable regulated rates will apply.
All prices are quoted in U.S. dollars. Estimates are not guaranteed fixed-price quotes unless stated in writing.
Service requests are dispatched based on equipment availability and location. Estimated arrival times are provided in good faith and may be affected by traffic, road conditions, weather, and the volume of active calls. We are not liable for delays caused by circumstances outside our control.
If you need to cancel a scheduled service call, please notify us as soon as possible. If a truck has already been dispatched and is en route at the time of cancellation, a trip or dry-run fee may be charged to cover the cost of dispatch. The applicable fee will be communicated at the time of cancellation.
Payment is due upon completion of services unless other arrangements have been made in advance (for example, under a fleet account or approved billing arrangement). We accept payment methods as communicated at the time of service. Failure to pay may result in your vehicle being held at a licensed storage facility and storage fees accruing until payment is received.
If you believe a charge is incorrect, please contact us promptly and we will review the itemized invoice. We provide a written receipt for all services rendered.
You are responsible for providing accurate information at the time of your service request, including the correct location, vehicle type, and a description of the situation. Providing incomplete or inaccurate information may delay response, result in the wrong equipment being dispatched, or affect the final cost.
You represent that you are the registered owner of the vehicle being towed, or that you have the authority of the owner to authorize towing services. We may request proof of ownership or authorization before releasing a vehicle.
If you are unable to direct the disposition of your vehicle at the time of service, it may be transported to a licensed storage facility. Daily storage fees will accrue from the time the vehicle arrives at the facility. We will provide you with the facility name, address, and contact information. We are not responsible for items left in vehicles during towing or storage.
To the fullest extent permitted by law, Momentum Fairfield Heavy Duty Towing Service shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services or your use of our website, including but not limited to loss of use, lost revenue, or loss of data.
Our total liability for any claim arising from services we provide shall not exceed the amount you paid for the specific service that gave rise to the claim. Some states do not allow certain limitations on liability - in those cases, the limitation shall apply to the maximum extent permitted by applicable law.
Our services are provided "as is" and without warranties of any kind, express or implied, except as required by applicable law.
